The
Hazard Communication Standard (HCS) under the Federal Occupational
Safety & Health Act requires the disclosure of information
(Material Safety Data Sheets) on certain industrial products.
However, the HCS does not apply to "articles",
defined under 1910.1200(c), as manufactured items which
are formed to a specific shape or design and which have
uses and functions which are dependent in whole or in part
upon its shape or design during use.
The
Occupational Safety and Health Administration (OSHA), in
a compliance directive issued in 1988, cites as examples
of articles, tires, stainless steel tables, adhesive tapes,
and similar "articles." Niagara Cutter's cutting
tools are articles and therefore, are exempt from the requirements
to provide as MSDS information on our products.
Niagara
Cutter fully supports the Hazardous Communications Standard
under the Occupational Safety and Health Administration
Act, which provides employers the ability to evaluate the
potential hazards of chemicals in their workplace and to
communicate such information and appropriate protective
measures to their employees. Under the Hazard Communications
Standard, however, data safety sheets are not required for
articles such as Niagara Cutter's cutting tool products.
